Divorce need not be adversarial

Although the divorce process can be contentious and adversarial at times, it certainly does not have to be. Sometimes, a marriage or a partnership just stops working. The legal term for this in Pennsylvania is an "irretrievable breakdown" of the marriage. And, if both spouses agree that divorce is the best course of action - and they remain amicable with one another - they can proceed with the divorce absent any adversarial court proceedings.

Remaining amicable and working together can help make the process of divorce easier and less difficult from an emotional standpoint. Keeping lines of communication open and being willing to work out differences will help the spouses come to a more agreeable resolution than litigation and/or court-ordered settlements. This is especially true when it comes to dividing property.

Working together to identify what assets you and your partner have will also help to smooth the way for an easier divorce. If you have children, agreeing on custodial rights, visitation and support - all of which can be later formalized by the court - will save time, money and stress. If a couple arrives at any issue that they cannot seem to overcome, the assistance of a mediator can help the process to continue.

Although you and your spouse may be working amicably toward a divorce, an experienced family law attorney can be invaluable for legal advice, drafting documents and helping to smooth any rough patches you encounter during the divorce process.
